    What is a nanny contract?

    A nanny contract is a legal agreement between a parent and the nanny, which specifies all the details of the job and other terms and clauses related to the job. The nanny is usually hired by the parents or guardians of the children to look after them. It also includes payment details and termination terms to avoid any issues in the future.

    A nanny is a person who takes care of a child when the parents are working.

    Nounou means nanny in French. The term “nanny” is used for both genders. Nannies can be of different genders.

     

     

    What are the types of nanny contracts?

    There are four types of contracts that parents can offer their nanny:

     

    • Part-time contract: it is an agreement that allows the nanny to work for the parents only when they need her. For example, if a parent works every day but needs a nanny one day a week, the part-time contract would be an option.

    • Full Time Contract: This option offers the parents and the nanny to have an agreement that specifies the working hours of the nanny for a given period of time.

    • Fixed-term contract: this agreement is concluded when the parents have a specific reason for hiring a nanny. For example, if you need help with children who are close to you or if you see friends at a place where there is child care, you can hire a fixed-term nanny.

    • Permanent contract: this agreement is concluded when you do not need a nanny for a long time. This may be the case if your children are young and you don't want to hire a nanny for a few years. It is also valid if you have older children who are in school or at home and you do not intend to keep them beyond kindergarten or college.

     

    Do I need a nanny contract?

    The nanny contract is important in many ways. This minimizes the risk of organizational problems between the two parties to the contract. The contract allows both parties to discuss and finalize important aspects of the job and other payment procedures. If you do not use a nanny contract, you will not be able to take legal action against another party in the event of an accident.

    What to put in a nanny contract?

    The important things you need to mention when writing a nanny contract are:

     

    General informations : This includes start date of work, address, family contact details, number of children who will be in the care of the nanny, legal name, address and contact details of the nanny.

     

    Hours and times: it includes the nanny's work schedule including start and end time of shifts, working days they are expected to work, details of additional shifts such as night or weekend end if the parents are not there. You can also mention their standard hourly rate in the contract.

     

    Salary : Clearly mention a nanny's salary including all taxes or deductions if there are any and also mention the additional bonus if you wish to fix it.

     

    Professional responsibilities: clarify all the tasks you want to entrust to the nanny. It includes the childcare schedule (feeding, cleaning, sleeping, playing, etc.). Apart from these, you can also mention secondary duties that you have entrusted to a nanny, such as light housekeeping, meal preparation, shopping, pet care, and laundry.

     

    Benefits/reimbursements: mention health care benefits such as health insurance, health care reimbursement account or allowance. 

     

    Withholding tax: Whether or not to withhold income tax is completely optional. If you keep part of their salary as a tax deduction, you must mention the amount and other legal details in your contract. Make sure you provide them with a W-2 form at the end of the year and report their income to federal and state tax agencies.

     

    Paid vacation : this includes vacation, sick time, paid time off, and other paid time off, and any terms and conditions for using this benefit. 

     

    Confidentiality clause : A confidentiality clause will help protect your family's privacy. Here you can clearly mention that your nanny cannot share photos of your children or any other personal information they learn about your family to stranger or on social media platforms. 

     

    House rules: if you have strict house rules for everyone to follow, you should mention these rules clearly in the contract so that your nanny cannot object to any of them later.

     

    Transportation : if you want your children's nanny to drive a family car to transport the children to/from school or pay zone etc., you need to clarify the driving rules including speed limit and use personal gadgets while driving.

     

    Nanny cameras: If you tell your nanny about using a nanny cam, it will help establish honesty at the start of your professional relationship.

     

    Home accommodation: If you hire a live-in nanny, you should clearly specify what is included in her accommodation and how meals and food will be handled.

     

    Termination Policy: you must mention the appropriate termination terms and policies for the contract with your nanny.
